Terms & Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between the user (“you,” “your,” or “Customer”) and FeedbackRobot (“we,” “us,” or “our”). By accessing the platform at www.feedbackrobot.com or using our services, you agree to these Terms in full.

1. Services and Platform Use

FeedbackRobot provides an AI-powered reputation management and customer feedback platform. This includes, but is not limited to:

  • AI Resolutions: Automated or semi-automated responses to customer reviews.

  • Reputation Monitoring: Aggregation of reviews from third-party platforms.

  • Feedback Collection: Generation and distribution of customer surveys.

  • Social Proof Tools: Widgets and automation for displaying customer testimonials.

We grant you a non-exclusive, non-transferable right to access the platform in accordance with your selected subscription plan.

2. AI Content and Accuracy Disclaimer

FeedbackRobot utilizes Large Language Models (LLMs) and Artificial Intelligence to generate content.

  • The "Human-in-the-Loop" Principle: While our AI is designed for high accuracy, it may occasionally generate "hallucinations" or inaccurate information. You are solely responsible for monitoring, reviewing, and approving any AI-generated responses or recovery offers before they are sent to your customers.

  • No Liability for AI Errors: FeedbackRobot is not liable for any financial loss, reputational damage, or legal disputes resulting from AI-generated content, including instances where the AI may offer unauthorized discounts or incorrect business information.

3. Third-Party Integrations

Our service interacts with third-party platforms including Google, TripAdvisor, Yelp, Facebook, and Instagram.

  • Compliance: You must comply with the terms of service of any third-party platform you connect to FeedbackRobot.

  • Account Access: You authorize FeedbackRobot to access these accounts on your behalf to fetch reviews and post responses.

  • Platform Changes: We are not responsible for service interruptions caused by changes to third-party APIs or the suspension of your third-party accounts.

4. White-Labeling and Sub-Accounts

For users on Agency or Enterprise plans:

  • Responsibility: You are responsible for the activity of all sub-accounts created under your primary account.

  • Branding: You may apply your own branding to the dashboard and reports as permitted by your plan. However, you may not claim the underlying proprietary technology of FeedbackRobot as your own IP.

5. Billing and Subscription

Payments: Subscription fees are billed in advance based on your chosen interval (Monthly or Annually). All payments are processed securely via our third-party payment processor.

  • Automatic Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing cycle.

  • No Refunds: To maintain the integrity of our AI resource allocation, we do not offer refunds for partial months or unused credits.

6. Data Ownership and License

User Data: You retain all rights to the customer data and feedback you collect through the platform.

  • License to Operate: You grant FeedbackRobot a license to process this data solely to provide the service, improve our AI models, and generate aggregated, anonymized insights.

  • Data Protection: We process all data in accordance with our Privacy Policy and applicable data protection laws (including GDPR and CCPA where applicable).

7. Prohibited Conduct

You agree not to:

  • Use FeedbackRobot to send spam or unsolicited marketing in violation of the CAN-SPAM Act.

  • Attempt to reverse-engineer the AI logic or scrape data from the platform.

  • Use the service to generate defamatory, hateful, or illegal content.

8. Limitation of Liability.

To the fullest extent permitted by law, FeedbackRobot and its affiliates shall not be liable for:

  • Any indirect, incidental, or consequential damages.

  • Loss of data, revenue, or profits resulting from your use of the platform.

FeedbackRobot’s total liability for any claim arising out of these Terms shall not exceed the amount paid by you to FeedbackRobot during the six months prior to the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

We reserve the right to suspend or terminate your access to the platform immediately, without notice, if you breach these Terms or fail to pay subscription fees. Upon termination, your right to use the platform ends, and we may delete your data in accordance with our retention policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
